Legal information

The name of this PTA unit shall be Everett View Ridge Parent Teacher Association (PTA) 7.3.50 (Service Area 7, Council Area 3, Local Unit 50).  The national PTA identification number of this association is 0023321.

The PTA serves the children and families enrolled at Everett View Ridge Elementary for the health, safety, education and welfare of the View Ridge Students.

This PTA is a non-profit corporation as directed by the Internal Revenue Service and outlined by the Washington Congress of PTA.  

The PTA was Incorporated on Nov. 5, 1979 and assigned corporation number 2-294186-8.  The treasurer is responsible for filing the annual corporation report through the office of Secretary of State prior to November 30th of each year.

The registered agent for this corporation is the Washington State PTA.

This PTA has an EIN and a UPI number.  That information is available upon request.

This PTA is registered under the Charitable Solicitations Act.  The treasurer is responsible for filing the annual registration by May 31st. Charitable Solicitations number 6034.

The accounting period for this PTA shall be July 1st through June 30th each year.

This PTA was granted tax-exempt status from the IRS under section 501c(3) on Aug. 6, 2010.  The current treasurer is responsible for filing IRS Forms 990 or 990EZ prior to Nov. 15th if required.

This PTA shall maintain at least two copies of its legal documents in separate locations.  The Treasurer and the Secretary shall maintain the documents. The Secretary shall maintain the original copy and provide copies of documents to other elected officers as necessary.

This PTA shall purchase liability insurance each year.  Additional coverage may be purchased at by discretion of the Board of Directors. It is the responsibility of the current Treasurer to renew the liability policy for this PTA by December 1st.  A copy of the current liability policy shall be kept in the Legal Documents Binder maintained by the Secretary.

These standing rules shall be used in conjunction with the Washington State PTA By-Laws, which are in conjunction with National PTA bylaws.

The standing rules shall be adopted annually at the first general meeting by majority vote of the members present.

Standing rules may be amended at any General Membership meeting by reaching quorum and majority vote.


Membership and Dues

Membership in this PTA shall be open to all people without discrimination. Membership is open to all View Ridge parents, guardians, teachers, staff, community members, and any other persons that support and encourage the purpose of the PTA.  

The Membership dues for this PTA shall be $15 per person or 2 members for $25, and $10 for staff. These dues may be changed by a majority vote of the unit's Board of Directors.

The students of View Ridge Elementary shall be considered honorary members of this PTA without voice, vote, or the privilege of holding office.

Only members in good standing of the association shall be eligible to vote or serve in any of its elected or appointed positions. Deadline for payment of dues by the Board of Directors shall be October 21st to ensure good standing.


Officers and their Election

The elected officers of the PTA shall be President, Vice President, Secretary and Treasurer.  Two people, with the exception of Treasurer, may hold a position jointly.  Each co-position shall be entitled to voice and vote at Board of Directors meetings.  Officers must be 18 years of age.

To be elected to office a person must be a member of this PTA unit for at least thirty days preceding the election.  An officer shall not be eligible to serve more than two consecutive terms in the same office.

The election of the Executive Committee shall take place at the general membership meeting on or before June 15 each year.  Executive officers shall assume their official duties on July 1st and shall serve for a term of one year (no more than 2 consecutive years in one position).  Newly elected officers will then have the opportunity to attend the Convention.

It is the duty of the President to inform WSPTA of newly elected officers immediately after their election.

The View Ridge PTA Executive Committee will ensure that each executive member attends a minimum of one WSPTA approved training during the PTA year.  Further, at least one member of the Executive Committee will attend PTA and the Law during the PTA year.


Executive Committee and Board of Directors.

The Executive Committee shall consist of the elected officers.  

The Board of Directors of the PTA shall consist of the elected officers and a minimum of 3 standing committee chairs appointed by the Officers.

If a vacancy occurs in an office, the Board of Directors may select an officer to fill the unexpired term.

All members of the Board of Directors must be current PTA members in good standing.

The vote for this PTA for the position of Washington State PTA Regional Director, delegates to the State Legislative Assembly and State Convention shall be determined by Executive Committee action.

The View Ridge PTA will have at least two members of the PTA Executive Committee in custody of a copy of all passwords related to PTA items to include accounting software, online passwords and PTA safe. The intent is to have redundancy should a board member leave or be relieved of their duties midyear. If a board member leaves midyear for whatever reason, the passwords are then changed. All passwords and combinations shall be changed once incoming officers assume office after July 1 annually.


Budget and Finance

This PTA shall approve its annual operating budget in the Spring of each year.  The proposed budget shall then be presented to the Board of Directors for final Board review and approval prior to the first fall general membership meeting.

The PTA shall conduct a financial review of its books and records at the close of each fiscal year, and with an option to audit at any time if decided by the Board of Directors.

The signatures of at least three Board of Directors shall be on the signature card for this PTA’s authorized bank account.  Checks will be signed by two signers.

All reimbursement requests shall include a receipt and shall be submitted to the Treasurer within sixty days of purchase.  All requests must be received by the last day of the school year.  The treasurer shall have authority to pay all budgeted expenses.  Any non-budgeted expenses shall be brought before the Board of Directors for approval.

The Board of Directors has the authority to reallocate funds up to $100 from one budget category to another when necessary without prior approval of the general membership.  The Board of Directors must inform the membership at the next occurring membership meeting.

Should the PTA receive a NSF check, any and all bank fees will be charged.

This PTA will follow best practice guidelines as outlined in the WA State PTA Money Matters handbook.


Meetings

For general Membership Meeting a quorum shall be defined as ten members of the general membership as of that meeting.  This is the minimum number of members who must be present at a meeting for business to be legally transacted.  

Adoption of the budget, adoption of the standing rules, election of the nominating committee, and election of the officers shall take place at general membership meetings.

General membership meetings shall be held at the direction of the Board of Directors with at least three meetings per year - held in person or virtually.

Special meetings of the board may be called by the President or upon written request by the majority of all members of the board.  Board of Directors quorum is defined as a majority of the Board.

Special general membership meetings may be called by the President or a majority of the Board of Directors by written notice delivered to the members not less than 10 days before the date of the special meeting.

One or more Golden Acorn and Outstanding Educator Awards shall be presented annually.  A committee composed of the prior year’s recipients shall select the current year’s recipient(s) from written Nominations.  The Executive Committee shall determine the number of recipients selected in any given year.
